TERMS AND CONDITIONS FOR THOU APP

  1. INTRODUCTION

These Terms and Conditions ("Terms") govern your use of the Thou mobile application ("App"), operated by Choba Pte. Ltd. ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the App.

  1. DEFINITIONS

  • "App" means the Thou mobile application.

  • "Content" means any information, data, text, or other materials displayed on or through the App.

  • "User," "you," or "your" refers to the individual accessing or using the App.

  • "AI" or "AI model" refers to the artificial intelligence technology provided by Anthropic that generates responses within the App.

  1. ELIGIBILITY

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this eligibility requirement. If you are between the ages of 13 and 18 (or the age of legal majority in your jurisdiction), you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

  1. ACCOUNT REGISTRATION

To use certain features of the App, you may need to register for an account. When you register, you agree to provide accurate, current, and complete information and to update this information to maintain its accuracy. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

  1. APP LICENSE AND RESTRICTIONS

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on a mobile device that you own or control.

You agree NOT to:

  • Modify, adapt, translate, reverse engineer, decompile, or disassemble the App

  • Remove any copyright, trademark, or other proprietary notices

  • Use the App for any illegal purpose or in violation of any local, state, national, or international law

  • Interfere with or disrupt the operation of the App

  • Attempt to gain unauthorized access to the App or its related systems

  • Use any robot, spider, crawler, scraper, or other automated means to access the App

  • Distribute, copy, rent, lease, or sublicense the App to any third party

  1. USER CONTENT AND SUBMISSIONS

When you submit information through the App (including queries about your feelings or situations), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content for the purposes of providing and improving the App's services.

You represent and warrant that your submissions:

  • Do not violate any third-party rights, including intellectual property rights

  • Do not contain any defamatory, obscene, or otherwise unlawful material

  • Do not violate these Terms or any applicable law

We reserve the right to remove any user submissions that we determine, in our sole discretion, violate these Terms or may be offensive, illegal, or violate the rights of any third party.

  1. AI-GENERATED CONTENT

The App uses Anthropic's AI technology to generate responses to your queries. You acknowledge and agree that:

  • All responses generated by the AI are created through automated processes and do not represent the views, opinions, or beliefs of actual Bible characters, religious figures, God, or human beings.

  • The AI responses are provided for inspirational, educational, or entertainment purposes only and should not be considered as professional advice, counseling, or religious teaching.

  • The accuracy, relevance, or appropriateness of AI-generated content cannot be guaranteed.

  • We are not responsible for any actions you take based on AI-generated content.

  • AI responses may occasionally contain inaccuracies or content that could be considered inappropriate or offensive. If you encounter such content, please report it to us.

  1. INTELLECTUAL PROPERTY

The App, including its content, features, and functionality, is owned by Choba Pte. Ltd. and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or other brand elements.

  1. PRIVACY

Your use of the App is also governed by our Privacy Agreement, which is incorporated by reference into these Terms. Please review our Privacy Agreement to understand our practices regarding the collection, use, and disclosure of your personal information.

  1. DISCLAIMERS

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE APP WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION

  • ANY ERRORS OR DEFECTS WILL BE CORRECTED

  • THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS

  • THE RESULTS OF USING THE APP WILL MEET YOUR REQUIREMENTS

YOU ACKNOWLEDGE THAT THE APP PROVIDES AI-GENERATED CONTENT THAT:

  • DOES NOT CONSTITUTE PROFESSIONAL RELIGIOUS, SPIRITUAL, PSYCHOLOGICAL, OR OTHER ADVICE

  • IS NOT A SUBSTITUTE FOR PROFESSIONAL COUNSELING, THERAPY, OR MEDICAL TREATMENT

  • SHOULD NOT BE USED AS THE SOLE BASIS FOR MAKING IMPORTANT PERSONAL DECISIONS

  1. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHOBA PTE. LTD., ITS AFFILIATES, OR THEIR DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

  • LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES

  • DAMAGES RELATING TO YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE APP

  • DAMAGES RELATING TO ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP

  • DAMAGES IN ANY MANNER BASED ON THE APP CONTENT, INCLUDING AI-GENERATED RESPONSES

THIS LIMITATION APPLIES WHETHER THE LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

  1. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Choba Pte. Ltd., its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney fees and costs, arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any third-party right.

  1. TERMINATION

We reserve the right to terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

Upon termination:

  • Your right to use the App will immediately cease

  • You must cease all use of the App and delete it from your devices

  • Sections of these Terms that, by their nature, should survive termination shall survive termination

  1. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on the App or through other reasonable means. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

  1. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the App shall first be resolved through good-faith negotiation. If such negotiation fails, any controversy or claim shall be submitted to binding arbitration in accordance with the rules of the Singapore International Arbitration Centre. The arbitration shall take place in Singapore, in the English language.

  1. SEVERABILITY

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

  1. ENTIRE AGREEMENT

These Terms, together with the Privacy Agreement, constitute the entire agreement between you and us regarding the App and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the App.
